GDPR replaces the Data Protection Directive (officially Directive 95/46/EC) of 1995 and is now the framework for data protection laws in Europe. The EU's GDPR website states that the legislation is designed to "harmonise" data privacy laws across Europe as well as give greater protection and rights to individuals. Additionally individuals, organisations, and companies that are either 'controllers' or 'processors' of personal data are covered by the GDPR which encompasses both personal data and sensitive personal data.

GDPR states that failure to comply will see smaller offences fined up to €10 million or two per cent of the firm's global turnover (whichever is greater). While more serious consequences can have fines of up to €20 million or four per cent of a firm's global turnover (whichever is greater).
